Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Garbage-Buddy (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legal agreement between you and Outofbox Inc. (“Company”, “we”, “us”, or “our”).

2. Description of Service

Garbage-Buddy is a mobile application that provides waste collection schedule information for residents of London, Ontario. The App connects to the City of London's official ZoneFinder API to retrieve accurate collection dates and provides additional features including:

• Smart address search and validation
• Real-time waste collection schedules
• Favorites system for multiple addresses
• Complete waste collection guidelines
• Direct links to City of London service portal

3. User Responsibilities

You agree to:

• Provide accurate address information when using the App
• Use the App only for lawful purposes
• Not attempt to reverse engineer, modify, or distribute the App
• Not use the App to spam or send unsolicited communications
• Respect the intellectual property rights of Outofbox Inc. and third parties
• Not attempt to gain unauthorized access to our systems or services

4. Data Accuracy and Disclaimers

While we strive to provide accurate and up-to-date information, we cannot guarantee the accuracy, completeness, or timeliness of waste collection schedule data. The information is sourced from the City of London's official systems, but:

• Collection schedules may change due to weather, holidays, or other factors
• Technical issues may temporarily affect data accuracy
• Users should verify collection information with official city sources when in doubt
• We are not responsible for missed collections due to inaccurate information

5. Intellectual Property

The App, including its content, features, functionality, design, and underlying software, is owned by Outofbox Inc. and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

6. Privacy and Data Collection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

7. Third-Party Services

The App integrates with third-party services, including:

• City of London ZoneFinder API for collection schedule data
• City of London Service Portal for issue reporting
• App distribution platforms (App Store, Google Play)

These third-party services have their own terms of service and privacy policies. We are not responsible for the content, privacy practices, or availability of these services.

8. Limitation of Liability

To the maximum extent permitted by law, Outofbox Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from missed waste collections
• Damages resulting from errors or inaccuracies in the information provided
• Damages resulting from unauthorized access to or use of our servers and/or personal information

9. App Availability and Updates

We strive to keep the App available at all times, but we cannot guarantee uninterrupted service. The App may be temporarily unavailable due to:

• Scheduled maintenance
• Technical issues or server problems
• Third-party service outages
• Force majeure events

We may update the App from time to time to improve functionality, security, or compliance. Some updates may be required for continued use of the App.

10. Termination

You may stop using the App at any time by deleting it from your device. We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms.

Upon termination, your right to use the App will cease immediately, and you must delete all copies of the App from your devices.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes through the App or other appropriate means. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law principles. Any disputes arising from these Terms or the use of the App will be subject to the exclusive jurisdiction of the courts of Ontario.
